(the “Event”)
Official Raffle Contest Rules
(the “Rules”)
1. HOW TO ENTER: The raffle (the “Raffle”) begins February 7, 2024 and ends July 8, 2024 one hour after the Event starts (CST) (the “Raffle Period”). Purchase a raffle ticket (the “Raffle Ticket”) during the Raffle Period for 1 for $50 or 3 for $135. Tickets will be available for sale: (i) from any EAF Board member or EAF Regional Coordinator, authorized committee member or Raffle designee; (ii) online at www.donate.akaeaf.org, but only on or before 12:00 pm (CST) on July 5, 2024 (the “Online Deadline”), (iii) at the 2024 Alpha Kappa Alpha Sorority, Inc. 71st Boule’ in Dallas, Texas from vendor opening on July 5, 2024 through vendor close on July 7, 2024 at the EAF Vendor Booth in the Exhibit Area of the Kay Bailey Hutchinson Convention Center, Dallas, Texas; and (iv) at the Event on July 8, 2024 until one hour after the Event starts (CST) if remaining unsold raffle tickets are available on that date. Fill out and submit the tab portion of the ticket to register for your chance to win the prize (as defined below). Raffle ticket stubs will be created by EAF for Raffle Tickets purchased online prior to the Online Deadline.
A “purchase” shall not occur and be binding on EAF until cash is received, or, if paid by check or online, funds received have cleared the bank. Accepted credit cards include Discover, Visa, MasterCard and American Express. Raffle Ticket purchases are not tax deductible or refundable. If an Entrant’s check or credit card is dishonored prior to the drawing, the entry ticket will be declared invalid. A $30 charge will be assessed for non-sufficient funds or stop payment checks unless prohibited by law.
Multiple entries allowed, but only one entry per Raffle Ticket. Each Raffle Ticket purchased shall constitute an "entry" into the Raffle, and the person to whom the Raffle Ticket is registered shall be the "Entrant." Although more than one name may be provided on the ticket registration form, the Raffle Ticket shall be registered to the first name listed, who shall constitute the sole Entrant for that Raffle Ticket. The winning Entrant shall be the "Winner" of the prize. Delivery of any prize will be made to the Winner, and the Winner must supply his/her social security number before the prize is tendered. It is the sole responsibility of the Winner to allocate a winning prize to other participants in case of a multiple entry registration, and the Winner shall hold harmless EAF in case of conflicting claims or disputes among multiple claimants.
Proceeds from the Raffle shall go to EAF for its scholarship and community assistance awards program.
2. ELIGIBILITY: The Raffle is open to legal U.S.A. residents who are at least 18 years of age or older, with a valid U.S. driver’s license, as of the time of the Raffle Ticket purchase. The Winner must also be able to qualify for auto insurance and be able to receive possession of the prize in compliance with all applicable laws and regulations, and/or enter into any other contract(s) required in connection with the possession or use of the Grand Prize (as defined below). Employees of EAF and Bob Ross Buick, Inc dba Mercedes-Benz of Centerville (Ohio) (the “Dealership”), as well as all persons involved in the design, administration or implementation of this Raffle, are not eligible to win.
3. RANDOM DRAWING: Completed Raffle Ticket stubs must be in the possession of an authorized representative of EAF before the time of the drawing. One Winner will be selected by a random drawing to be conducted at the Event on July 8, 2024. All decisions by EAF concerning any matter related to this Raffle shall be final. The Winner will be announced during the Event. If the Winner is not present at the Event, the Winner will be notified by telephone and/or mail, based on contact information provided by the Entrant on his/her entry form. If a Winner cannot be reached within seven (7) days from the first notification attempt, then such person may be disqualified and an alternate Winner selected through a random drawing from the remaining entries. The Winner will be required to execute and return an Affidavit of Eligibility and Release and/or other documents required by EAF and/or the Dealership, within a time period to be indicated within such documents. If any Winner fails to comply with these requirements within the time period specified, does not meet the eligibility requirements of these Rules, or otherwise does not comply with these Rules or accept the prize, the Winner may be disqualified and an alternate Winner selected through a random drawing from the remaining entries. The Grand Prize only inures to the designated Winner and, prior to taking title to the Grand Prize, that person may not sell, assign, gift or otherwise transfer the Grand Prize to any other person or entity.
4. PRIZE / APPROXIMATE RETAIL VALUE: Odds of winning are based on the total number of entries (tickets sold) received. The “Grand Prize” will consist of the following:

The approximate retail value of the Grand Prize is $48,000. EAF has the right to substitute an alternative vehicle of equal or greater value as the Grand Prize. The Winner shall solely be responsible for securing and paying all necessary auto insurance coverage (proof of which must be shown prior to pick up or delivery), pickup or delivery costs at the Dealership as well as any non-standard features chosen by the Winner and negotiated with the Dealership, auto maintenance, gasoline, and any and all other and associated costs, expenses and fees, including, but not limited to, any and all applicable federal, state and local taxes (including without limitation all applicable withholding, sales, use, luxury, income and special taxes), title, license, transportation, delivery, registration and tag fees. The Winner must claim the Grand Prize at the Dealership located at 1 Loop Rd, Centerville, OH 45459, Ph: (937) 433-2698, by Friday, August 9, 2024. The Winner acknowledges that acceptance of the Grand Prize is a taxable event (see paragraph 6 below) and that he/she may wish to seek independent accounting advice in connection with the acceptance of the prize. The Grand Prize is provided by the Dealership, subject to reimbursement by EAF from Contest proceeds. EAF makes no representations or warranties as to the Grand Prize, and the Winner accepts the Grand Prize “as is.” The Grand Prize may not be used in conjunction with any other promotion or offer from the Dealership or any other entity. The Grand Prize cannot be exchanged for cash. If the Winner elects not to accept the vehicle, no substitution or exchange for cash or other goods will be provided and the Winner will be disqualified. In such event, EAF will select an alternate Winner.
The terms and conditions of the Dealership’s and manufacture’s transfer documentation and warranties will govern liability issues relating to the Grand Prize after acceptance of the Grand Prize by the Winner.
All applicable discounts, rebates, and incentives associated with the purchase of the Grand Prize are claimed by and payable to EAF.
5. GENERAL RULES: The Raffle is void wherever prohibited or restricted by law. All applicable federal, state and local laws and regulations apply. EAF is not responsible for incomplete, lost, late, damaged, or misdirected entries not received in time for the drawing, or for Raffle Tickets purchased after the Raffle Period or for Raffle Tickets purchased online after the Online Deadline. Entry materials that are incomplete or illegible may be deemed void and not accepted. All materials submitted become the sole property of EAF and will not be returned. Return of any prize notification as undeliverable may result in disqualification, and an alternate Winner may be selected. Acceptance of the Grand Prize constitutes permission to EAF and the Dealership to use the Winner’s name, image, likeness, photographs, voice and videotape in connection with promotion of this Raffle and waives any claims to royalty, rights, or remuneration for such use for purposes of advertising and trade, except where prohibited by law.
Any tradenames, trademarks or service marks shown as part of the materials associated with this Raffle drawing are the property of their respective owners.
The decision of EAF shall be final in all matters concerning the Raffle.
The Winner agrees to hold harmless EAF, BOB ROSS BUICK, INC. DBA Mercedes-Benz of Centerville (Ohio), and their respective affiliates, and its and their officers, directors, agents, employees, and assigns, from and against any and all claims and liabilities, including without limitation, property damage, personal injury and/or death, arising out of winner’s participation, acceptance, use or misuse of the Prize. The Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Raffle or use, misuse, acceptance or redemption of the Prize. By participating in the Raffle, Entrants agree that no claim relating to damages, losses or injuries shall be asserted against EAF and/or BOB ROSS BUICK, INC., DBA Mercedes-Benz of Centerville (Ohio), their respective affiliates, or its or their officers, directors, agents, employees, and assigns. EAF is not responsible for any typographical or other error in the printing of these Rules, administration of the Raffle, or the announcement of the Prize or the Winner.
an entrant’s SOLE AND EXCLUSIVE REMEDY FOR A BREACH BY eaf and/or BOB ROSS BUICK, INC., DBA Mercedes-Benz of Centerville (Ohio),SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER RAFFLE TICKET(S). IN NO EVENT SHALL eaf and/or BOB ROSS BUICK, INC., DBA Mercedes-Benz of Centerville (Ohio), ITS DIRECTORS, OFFICERS, EMPLOYEES, members, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EAF reserves the right to suspend or terminate the Raffle if the administration, security, fairness, integrity, or proper conduct of the Raffle is jeopardized or if the number of Raffle Tickets sold does not generate sufficient proceeds. In such event, the Raffle will be conducted not later than 30 days from the originally scheduled date, if possible, and, if the prize is not awarded within such 30 days, EAF will refund the amount paid by each Entrant who purchased a Raffle Ticket.
6. INCOME TAX AND WITHOLDING REQUIREMENTS. All federal, state and local taxes associated with the receipt and use of the vehicle are the sole responsibility of the Winner. All federal, state and local taxes are based on the final actual retail value of the vehicle. The IRS currently requires income tax withholding of 24% on cash and non-cash prize values of $5,000 or greater which must be paid upon award and distribution of the Grand Prize. This means that the Grand Prize Winner must pay to EAF an amount equal to 24% of the retail value of the Grand Prize (as stated in paragraph 4 above) as a condition of winning and to receive the Grand Prize. In the event that the Winner elects not to pay the withholding tax to EAF, then that Winner will be disqualified and EAF shall select an alternate Winner as set forth in these Rules. Government rules governing withholding can change without notice. EAF will follow the rules in effect at the time the prizes are awarded. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Check with your qualified financial advisor for additional information. In addition the Winner will be required to complete and furnish to EAF all required tax forms before EAF authorizes the Dealership to deliver the Gand Prize to him/her.
The Raffle is governed by the laws of the State of Texas. The Winner agrees to submit to the jurisdiction and venue of Federal and State courts located in Dallas County, Texas in any litigation proceedings arising hereunder.
